The Africans taken by the slave traders were often prisoners of war as well. Don't forget that in Rome crucifixion was reserved only for slaves and criminals. That's a pretty horrible way to die. I don't consider the slaves aiding the Roman legions to be soldiers just as I don't consider the slaves doing menial labor for the Confederate army to be soldiers.
