I read about that on Yahoo and came away with several questions on what was happening. First it sounded like he was playing video games with his brother but had the cannon in his lap. Why? Second, they often put tin foil balls into the thing along with black powder. The charge can be dangerous enough, but those tin foil balls become projectiles. Was this a case of putting in a tin foil ball? Third, why is it being called a toy? To me, unless it's springloaded or uses a little air or water, any cannon that can be fired is not a toy no matter how small.

It's tragic this happened to the kid, but the way these articles are written they just cause more questions.
